By using Finbase's (also referred to as us, our and we) website you indicate that you accept and will abide by these website terms of use and our privacy policy (together, the Terms of Use) including any terms that we may amend from time to time. If you do not agree to these Terms of Use, please refrain from using our website and the Platform.
2. All terms defined in our terms and conditions of service (Terms and Conditions) apply in these Terms of Use, unless the context requires otherwise.


Acceptable Use

3. You may, in accordance with these Terms of Use:
3.1. view pages from our website in a web browser;
3.2. download pages from our website for caching in a web Browser;
3.3. print pages from our website; and/or
3.4. use our website to access and use the Platform, and you must not use our website for any other purpose.

9. We aim to update our website regularly and may change the content at any time. If the need arises, we may suspend access to our website, or close it indefinitely. We will not be liable if for any reason our website is unavailable at any time or for any period. Any of the material on our website may be out of date at any given time, and we are under no obligation to update such material.

If you are provided with a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. Security

We will not be liable for any loss or damage caused by any technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website it links to.

Where our website contains links to other websites and resources provided by third parties, these links are provided for your information only and are not necessarily checked, approved or endorsed by us. We have no control over, and we are not responsible for, the availability of the links, the contents of those websites or resources, or their compliance with law, and we accept no responsibility or liability for them or for any loss or damage that may arise from your use of them.

You may link to our home page on a website owned by you, provided you do so in a way that is fair and legal and does not damage our reputation, but you must not suggest any form of association, approval or endorsement on our part where none exists. Our website must not be framed on any other website.

Privacy

21. We are committed to respecting your privacy. We will always collect, store, use and disclose personal information in accordance with applicable privacy laws. However, we have also put in place a privacy policy to protect personal information you submit or we collect.

29. We are committed to full compliance with the Unsolicited Electronic Messages Act 2007. By subscribing to emails and/or text communications, or otherwise providing your email address and/or mobile number, you consent to receiving emails and/or texts (as the case may be) which promote and market our products and services, or the products and services of others, from time to time. We will ensure we include accurate sender information and a functional unsubscribe facility.

Jurisdiction

31. These Terms of Use are governed by the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand. We reserve the right to bring proceedings against you for breach of these Terms of Use in your country of residence or
any other relevant country.


Variations

32. We may revise these Terms of Use at any time (with immediate effect) and will notify you of any changes by posting an updated version on our website. Please do not make any assumption that these same terms of use will apply to your future use of our website. We recommend you regularly visit our website and check whether these Terms of Use have changed. If you do not agree with any part of these Terms of Use (including as altered, modified or updated) you must not continue to use our website.
